1. Who we are

Flovi (Pty) Ltd is the data controller for personal information processed through flovi.co.za and the Flovi platform. Contact us at [email protected] or +27 78 855 1174.

2. Information we collect

  • Your name, email address, phone number, and business details at signup
  • Business information (services, pricing, FAQs) provided during onboarding
  • WhatsApp conversation content between your clients and your AI agent
  • Payment information, processed securely by our payment provider. We never see or store card details
  • Usage data such as message volumes, response times, and conversion metrics

3. How we use your information

  • To build, configure, and operate your WhatsApp AI agent
  • To send lead alerts, booking briefings, and account notifications
  • To process your subscription and billing
  • To improve the Flovi platform and AI response quality
  • To comply with South African law including the POPIA Act

4. Third-party processors

To deliver the service, your data may be processed by: Anthropic (Claude AI for language understanding), Meta (WhatsApp Business Platform), Supabase (database hosting), and Railway (application hosting). Each provider is bound by data processing agreements that meet POPIA requirements.

5. POPIA compliance

We comply with the Protection of Personal Information Act, 2013 (POPIA). You have the right to access, correct, or request deletion of your personal information at any time. Contact [email protected] to exercise these rights, or lodge a complaint with the Information Regulator of South Africa.

6. Data retention

We retain your account data and WhatsApp conversation history for 24 months following the date of collection or your account cancellation, whichever is later. You may request earlier deletion at any time by emailing [email protected].

Refund Policy

1. 30-day free trial

Every Flovi plan includes a 30-day free trial. Your card is captured at signup but never charged before Day 31. If you cancel any time during the trial, you pay nothing.

2. After your first charge

Once your first monthly charge is processed, that month is non-refundable. You will continue to have full access to the service for the remainder of the billing period you have paid for.

3. Cancelling before your next billing cycle

You can cancel any time. Cancel before your next billing date and you won't be charged again. There are no termination fees and no contractual minimums.

4. Setup fees

Full setup and onboarding is included in all plans. There is no separate setup fee to refund.

5. Disputes and questions

If you believe you've been charged incorrectly, email [email protected] within 30 days of the charge and we will investigate and resolve promptly.

Terms of Service

1. Acceptable use

You agree not to use Flovi to send spam, unsolicited bulk messages, deceptive content, or any unlawful communications. You will comply with Meta's WhatsApp Business policies and South African law at all times.

2. Service availability

We target 99% uptime. Scheduled maintenance is communicated in advance where possible. Flovi is not liable for downtime caused by third-party providers including Meta's WhatsApp Business Platform.

3. Client responsibilities

You are responsible for maintaining your WhatsApp Business account in good standing, complying with Meta's policies, and ensuring all content provided to Flovi is accurate and lawful.

4. Suspension

Flovi reserves the right to suspend accounts that violate Meta's policies, applicable law, or these Terms. We will notify you and provide a reasonable opportunity to cure where possible.

5. Subscription and billing

Plans are billed monthly in South African Rand. Pricing may change with 30 days' written notice. Cancellation terms are set out in our Refund Policy.

6. Intellectual property

The Flovi platform, software, and brand are owned by Flovi (Pty) Ltd. Content you provide remains yours. You grant Flovi a limited licence to use your content solely to operate the service.

7. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of Johannesburg.
